Issue 11 of Ozannes’ “Guernsey Brief” covers two new developments in Guernsey: The introduction of the Qualifying Investor Funds Regime (QIFs) by the GFSC, and the proposed reform of Guernsey’s trust legislation. Issue 10, an “Employment Special”, was published in March 2005 and is dedicated solely to recent developments in this particular field of Guernsey law. The requirements of employers under The Rehabilitation of Offenders Law and The Data Protection Law are examined, and an English Court of Appeal case is reviewed (Dacas v Brook Street Bureau [2004] EWCA Civ 217) regarding the question of “When is an Employee not an Employee?”. A contract checklist is also included, which lists all the specific points that need to be incorporated into the terms and conditions of an employment contract, together with profiles of Ozannes’ Employment team.
